Can I vote on a contract if my brother owns the business?

Under Louisiana Revised Statute 42:1112, public officials may not participate in transactions where immediate family members stand to benefit. Your brother is considered an "immediate family member". Even if the contract seems fair, your involvement in voting, discussion, or influencing the process would violate ethics rules. You must recuse yourself, and the recusal should be stated publicly and reflected in the minutes.

  • Inform your council and city attorney in writing.

  • Step out of room during and discussion or vote.
